Factic Terms of Service & Acceptable Use Policy

These Terms of Service ("Terms") govern your access to and use of the Factic mobile application, including notifications, quizzes, community features, subscription services, and related functionality (the "Service") provided by QWERTY Code LLC ("we," "us," "our"). By downloading, installing, or using the Service, you agree to these Terms.
1. Overview
Factic is a mobile learning application that delivers educational notifications, quizzes, and personalized learning experiences to users. The Service allows users to create custom learning topics, configure notification schedules, take quizzes, and share topics with the community.

2. Accounts & Eligibility
- You must be at least 13 years of age to use the Service. If you are between 13 and 18, you must have parental or guardian consent.
- You are responsible for maintaining the security of your account credentials.
- You must provide accurate and current information during registration.
- You are responsible for all activity conducted under your account.
- One person or entity may not maintain multiple accounts.
3. Service Description
Factic provides:
- Learning Notifications: Scheduled push notifications containing educational content tailored to your chosen topics.
- Quizzes: Optional quizzes to test your knowledge on notification content.
- Custom Topics: The ability to create personalized learning topics with custom schedules.
- Basic Topics: Pre-built learning topics across common subjects.
- Community Features: The ability to share and discover topics created by other users.
The Service requires an active internet connection and a compatible iOS device. Notification delivery depends on device settings, network availability, and platform limitations beyond our control.
4. User Content & License
You retain ownership of content you create (topic titles, descriptions, configurations). By creating and optionally sharing content through the Service, you grant us a worldwide, royalty-free, non-exclusive license to host, store, reproduce, display, and distribute it as necessary to operate and improve the Service.
You represent that your content does not infringe upon any third-party rights, is not unlawful, and does not contain harmful, abusive, or objectionable material.
5. Community Topics
Topics shared with the community are made available to other users. By sharing a topic:
- You grant other users the right to use your shared topic configuration.
- You acknowledge that shared topics may be copied and modified by other users.
- We reserve the right to remove community topics that violate these Terms.
- We do not guarantee the accuracy, quality, or educational value of community-created content.
6. Subscriptions & Payments
Free Tier
The Service offers limited free functionality, including basic topics with restricted notification frequency and limited topic creation.
Factic Pro
Premium features (unlimited custom topics, quizzes, increased notification frequency, community access) are available through a paid subscription ("Factic Pro").
- Subscriptions are billed through Apple's App Store and managed by your Apple ID account.
- Payment is charged to your Apple ID account at confirmation of purchase.
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
- You may manage and cancel subscriptions through your device's Settings > Apple ID > Subscriptions.
- Refunds are subject to Apple's refund policies.
- Prices may change with advance notice; continued use after price changes constitutes acceptance.
Trial Period
We may offer trial periods for Factic Pro. If a trial is offered, you will not be charged until the trial period ends. You may cancel during the trial to avoid being charged.
7. Acceptable Use Policy
You agree not to:
- Use the Service for any illegal or unauthorized purpose.
- Upload or share offensive, harmful, misleading, or inappropriate content.
- Attempt to reverse engineer, decompile, or disassemble the application.
- Interfere with, disrupt, or place undue burden on the Service or its infrastructure.
- Circumvent or attempt to bypass subscription restrictions, rate limits, or access controls.
- Impersonate another person or entity.
- Use automated means to access or interact with the Service without authorization.
- Manipulate community metrics, ratings, or download counts.
- Transmit viruses, malware, or harmful code through the Service.
8. Enforcement
We may, at our sole discretion:
- Remove or restrict content that violates these Terms.
- Limit or revoke access to features.
- Suspend or permanently terminate accounts for repeated or severe violations.
- Report illegal activity to law enforcement authorities.
9. Intellectual Property
The Service, including its design, code, algorithms, branding, notification content generation systems, quiz logic, and all related intellectual property, are owned by QWERTY Code LLC and protected by applicable intellectual property laws.
These Terms do not grant you any right, title, or interest in the Service beyond the limited license to use it as described herein.
10. AI-Generated Content
Factic uses artificial intelligence to generate notification content, quiz questions, and learning material. While we strive for accuracy:
- AI-generated content may contain errors, inaccuracies, or outdated information.
- Content is intended for general educational purposes only and does not constitute professional, medical, legal, financial, or academic advice.
- You should independently verify information before relying on it for important decisions.
- We do not guarantee the correctness, completeness, or fitness of AI-generated content for any particular purpose.
11. Warranty Disclaimers
THE SERVICE AND ALL CONTENT (INCLUDING AI-GENERATED NOTIFICATIONS, QUIZZES, AND LEARNING MATERIALS) ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT NOTIFICATIONS WILL BE DELIVERED AT ALL SCHEDULED TIMES.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, QWERTY CODE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID US IN THE PREVIOUS 12 MONTHS OR (B) US$50.
13. Indemnification
You agree to defend, indemnify, and hold harmless QWERTY Code LLC, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your content, or your violation of these Terms.
14. Changes
We may update these Terms from time to time. We will notify you of material changes through the app or by other reasonable means. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
15. Termination
- You may delete your account at any time through the app's settings.
- We may suspend or terminate your access for violations of these Terms.
- Upon termination, your license to use the Service ends immediately.
- Sections relating to intellectual property, disclaimers, limitations of liability, and indemnification survive termination.
16. Governing Law & Disputes
These Terms are governed by the laws of the State in which QWERTY Code LLC maintains its principal place of business, without regard to conflict of law principles.
Any disputes arising under or in connection with these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
17. Miscellaneous
- Entire Agreement: These Terms, together with the Privacy Policy and EULA, constitute the entire agreement between you and QWERTY Code LLC regarding the Service.
- Severability: If any provision is found unenforceable, the remaining provisions continue in full force.
- No Waiver: Failure to enforce any right or provision does not constitute a waiver.
- Assignment: We may assign these Terms in connection with a merger, acquisition, or sale of assets. You may not assign your rights without our written consent.
- Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control.
